The High Court in Accra has directed the Attorney-General’s Department to immediately assume responsibility for all criminal prosecutions currently being handled by the Office of the Special Prosecutor (OSP), pending formal authorisation from the Attorney-General.
The ruling, delivered on Wednesday, April 15, represents a major development in Ghana’s anti-corruption and prosecutorial framework, effectively transferring interim control of ongoing criminal proceedings to the Attorney-General’s office.
The Court further declared that all prosecutions initiated by the OSP are null and void, a decision that immediately halts a number of ongoing and high-profile cases before various courts across the country.
Presiding Judge John Nyante Nyadu also imposed costs of GH₵15,000 against the OSP, citing procedural issues raised during the proceedings.
