Sky Train Case: Court Gives Former GIIF Bosses Until September 23 to File Defences

The High Court has granted former Ghana Infrastructure Investment Fund (GIIF) Chief Executive Officer Solomon Asamoah and former Board Chairman Prof Christopher Ameyaw-Akumfi additional time to prepare and file their defences in the ongoing Sky Train case.

The two accused persons have been given until September 23, 2026, to submit their respective defences.

It is the third extension granted by the court since it rejected their submissions of no case to answer, allowing the prosecution to proceed with the trial.

The case centres on an alleged US$2 million loss to the state linked to a payment made by GIIF in 2019 towards an equity interest in the company behind the proposed Ghana Sky Train project.

The prosecution alleges that the payment was made without the necessary approval from the GIIF Board. The proposed Sky Train project subsequently failed to materialise, with the state allegedly losing the funds committed to the investment.

Mr Asamoah and Prof Ameyaw-Akumfi had previously argued that the prosecution had not presented sufficient evidence to warrant requiring them to open their defence.

The trial court, however, dismissed the submissions of no case and directed the accused persons to proceed with their defence.

Deputy Attorney-General and Minister for Justice, Dr Justice Srem-Sai, confirmed the latest development in a Facebook post on Monday, August 24, stating that the High Court had granted the two former GIIF officials further time to file their responses.

The case is now set against another significant legal development at the Supreme Court.

On Thursday, August 27, the apex court is expected to hear an interlocutory injunction application filed by Mr Asamoah’s lawyers.

The application seeks to suspend proceedings at the High Court while the Supreme Court considers a separate application challenging the trial court’s decision to dismiss Mr Asamoah’s submission of no case.

The outcome of the Supreme Court proceedings could therefore have implications for the continuation of the trial at the High Court as the accused persons prepare to formally open their defence.
