Court of Appeal Slams Brakes on NAM1’s Delay Tactics

Nana Appiah Mensah, aka NAM 1

The Court of Appeal has dismissed an application by Nana Appiah Mensah, Chief Executive Officer of defunct Menzgold Ghana Limited, to halt his ongoing criminal trial. NAM1 had sought to stay proceedings pending the determination of an appeal challenging a High Court ruling that ordered him to open his defense.

The High Court had directed NAM1 to defend himself against charges including sale of gold without a license, fraudulent breach of trust, defrauding by false pretence, and money laundering. The Court of Appeal, presided over by Justice Gbiel Suurbaareh, unanimously dismissed the application, upholding state prosecutors’ argument that it lacked exceptional circumstances to justify a stay.

Spokesperson for aggrieved Menzgold customers, welcomed the decision as a step toward justice. NAM1’s legal team, however, plans to consider further appeal to the Supreme Court.
