The Supreme Court has dismissed an application by former Ghana Infrastructure Investment Fund (GIIF) CEO Solomon Asamoah seeking to halt the ongoing Skytrain trial.
Mr Asamoah, the first accused, had asked the Court to restrain the High Court from continuing the trial while it considered his application to quash the High Court’s decision dismissing his submission of no case.
However, Justice Senyo Dzamefe, sitting as a single judge, dismissed the injunction application on Monday, August 31, 2026.
The Court held that Mr Asamoah’s affidavit did not establish a serious case to be tried and that the issues raised were matters for an appeal. It also found that the High Court acted within its jurisdiction when it ruled on the submission of no case.
The Court further ruled that Mr Asamoah had not demonstrated any irreparable harm that would result from allowing the trial to continue.
The decision clears the way for the High Court to proceed with the case. The accused persons have until September 23 to file their defence.
Meanwhile, the second accused, former GIIF Board Chairman Professor Christopher Ameyaw Ekumfi, has filed a fresh application for a stay of proceedings, which the Court of Appeal is scheduled to hear on September 1.
The two former GIIF officials are standing trial over allegations that US$2 million was paid towards the Skytrain project without approval from the GIIF Board.
