The Supreme Court has ruled in favor of striking out a supplementary affidavit filed by suspended Chief Justice Gertrude Torkornoo in support of her injunction application. The affidavit claimed she was treated inhumanely, had her dignity violated, and described the ongoing proceedings as a “mockery of justice” and a “ruse” aimed at removing her from office unjustifiably.
However, a five-member panel of the court upheld the deputy Attorney General’s objection, citing Article 146(8) of the Constitution, which requires proceedings for the removal of justices to be conducted in private. The court found that Torkornoo’s affidavit breached this confidentiality provision by disclosing aspects of the committee’s deliberations.
Despite arguments from former Attorney General Godfred Yeboah Dame that the affidavit was submitted within a judicial forum and not made public, the Supreme Court ruled that the contents of the affidavit indeed violated constitutional requirements and struck it out.
