The High Court has adjourned proceedings in the ongoing legal battle between suspended Chief Justice Gertrude Torkornoo and the Attorney General to July 31, 2025, when it will deliver its decision on a motion seeking to strike out the Chief Justice’s application for judicial review.
Chief Justice Torkornoo has filed a certiorari application, arguing that the impeachment process is violating her fundamental human rights. The application challenges the legality of the impeachment mechanism, following the dismissal of three previous injunction applications by the Supreme Court.
In court, legal teams representing both sides clashed over whether the Attorney General is obligated to provide “further and better particulars” in response to a letter from the Chief Justice’s lawyers. The Chief Justice’s team argued that the request is legitimate and seeks factual clarity, while the Attorney General’s team described it as an improper attempt to extract legal advice from an adversary.
The court has directed both parties to file written submissions on specific legal issues, including whether the application duplicates matters already decided or pending before the Supreme Court and whether the High Court has jurisdiction to entertain exhibits from the Article 146 impeachment committee proceedings.
The parties are expected to file their written submissions by July 28 and 29, 2025, and the court will deliver its ruling on July 31, 2025, at 9:00 a.m. The outcome of the case will determine whether the Chief Justice’s application for judicial review will proceed or be struck out.
